Terms of Service

These Terms of Service apply to all contracts and uses between lio.gg - Sven Rolnik ("Provider", "we") and you ("User", "you") regarding the services at https://lio.gg, in particular the dashboard and the Discord bot "Lio".

We do not recognize deviating terms of the user unless we expressly agree to their validity in writing. A consumer within the meaning of these Terms is any natural person who enters into a contract for purposes that are predominantly neither attributable to their commercial nor to their independent professional activity.

Lio.gg is a modular Discord bot with an associated web dashboard. Through the dashboard, you can set up the bot on Discord servers, activate modules, and configure them (e.g. Welcome, Leveling, Logging, Tickets, roleplay tools).

The Provider operates the bot, API, and dashboard centrally ("hosted"). You do not receive access to the source code or infrastructure unless expressly agreed.

The scope of features and available modules may vary depending on the plan (Free, Plus, Premium/Pro) and may change over the course of further development.

The bot "Lio" interacts with servers on which it has been invited via the Discord API. It is an independent application and is not affiliated with Discord Inc. Discord is a trademark of Discord Inc.

Use of the bot requires that you (a) comply with Discord's Terms of Service, (b) use the bot only on servers for which you are authorized, and (c) grant the required permissions when inviting the bot.

The bot processes data on Discord (messages, roles, events, etc.) only within the scope of modules activated by the user. Details on data processing can be found in our Privacy Policy.

The Provider is entitled to update the bot, adjust or discontinue modules, provided that the contractually owed main service is not unreasonably impaired.

Use of the dashboard requires login via Discord OAuth2. You must be at least 18 years old or have the consent of a legal guardian where required by law.

You are responsible for keeping your access credentials confidential and ensuring that only authorized persons with Manage Server permissions can access your server configuration.

We may suspend or terminate accounts if you violate these Terms, applicable law, or Discord guidelines, or if you misuse the platform.

You agree in particular to:

• not use the bot and dashboard for unlawful, harassing, or harmful purposes
• appropriately inform server members when modules process personal data (e.g. logging, moderation)
• not infringe third-party rights (copyright, trademark, personality rights), especially with embed content and configured texts
• not circumvent security mechanisms and not conduct automated attacks on our infrastructure
• pay agreed fees on time for premium features

Modules (Welcome, XP/Leveling, Logging, Tickets, Moderation, Giveaways, Lager, etc.) require different Discord permissions (e.g. send messages, manage roles, read members). You configure modules at your own risk and ensure that the bot receives the necessary permissions.

You are solely responsible for content that the bot posts based on your configuration (texts, embeds, logs). The Provider does not review this content in advance.

Plans such as "Free", "Plus", and where applicable "Pro" are currently offered. Current prices are available on the website at https://lio.gg.

Paid plans renew automatically for the respective billing period unless stated otherwise, if you do not cancel before expiry. Cancellation is possible via the dashboard or by email to support@lio.gg.

Invoices are provided electronically. In case of payment default, we are entitled to restrict access to paid features.

No VAT identification is shown because the small business regulation pursuant to § 19 German VAT Act applies.

If you are a consumer within the meaning of § 13 German Civil Code (BGB), paid plans (Plus, Premium/Pro, etc.) are subject to the statutory right of withdrawal: you may withdraw from the contract within 14 days without giving reasons (§ 355 BGB in conjunction with §§ 312g, 356 BGB).

We refer to this statutory consumer right as the "14-Day Money-Back Guarantee". To exercise it, send a clear statement (e.g. by email) to support@lio.gg within 14 days of the day the contract is concluded or payment is received for the respective paid plan.

If withdrawal is effective, we will refund amounts already paid without undue delay and at the latest within 14 days of receiving your withdrawal notice, using the same payment method unless otherwise agreed.

Refunds are not granted after this 14-day period has expired, unless mandatory law (e.g. claims for defects) requires otherwise. Entrepreneurs within the meaning of § 14 BGB have no right of withdrawal.

If you expressly agreed that we begin performance before the withdrawal period ends and confirmed that you are aware withdrawal may expire once the digital service is fully performed, the right of withdrawal may end early where the service has been fully delivered (§ 356 para. 5 BGB). We will inform you before performance begins where required by law.

We strive for high availability of the bot and dashboard but do not guarantee uninterrupted operation. Maintenance, updates, and outages at Discord or infrastructure providers may lead to temporary limitations — including individual modules or features being unavailable for a short time.

Our systems are designed to be robust and performant. Temporary outages can nevertheless occur and are normal for online services. We work to restore service quickly when issues arise.

We announce planned maintenance in advance where possible (website, Discord, or dashboard notice).

The Provider is fully liable for intent and gross negligence as well as for damages resulting from injury to life, body, or health.

In case of slight negligence in breach of essential contractual obligations (cardinal duties), liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded to the extent permitted by law.

We are liable for data loss only to the extent that you have made reasonable data backups and the loss would also be recoverable with proper backup.

We are not liable for actions by Discord, server members, or content you publish via the bot. Liability under product liability law remains unaffected.

We do not accept liability for temporary or partial unavailability of individual modules, dashboard areas, or bot functions, nor for data loss or damage arising from such outages, except in cases of intent or gross negligence or where mandatory consumer law provides otherwise. This does not affect your statutory rights as a consumer.

You may stop using the service at any time by removing the bot from your Discord servers and, if applicable, requesting deletion of your dashboard account (support@lio.gg).

Paid subscriptions must be terminated in compliance with the cancellation period. Refunds for consumers are only available within the "14-Day Money-Back Guarantee" (Section 8); after that period, refunds are not granted unless mandatory law provides otherwise.

We may terminate the contract without notice for good cause, in particular in case of serious violations of these Terms or misuse.

We may amend these Terms when substantive reasons require it (e.g. new modules, legal changes, plan adjustments). We inform registered users of material changes in text form (email or dashboard). If you do not object within 30 days of receiving the notice, the amended Terms are deemed accepted. We will point this out in the notice.

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country of residence remain unaffected for consumers with habitual residence in the EU.

If the user is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is the Provider's registered office, where permitted by law.

Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
